Interpretation and Definitions

Interpretation – Words with initial capital letters have specific meanings defined under the following conditions. These definitions apply regardless of whether they appear in singular or plural form.

Definitions – For the purposes of this Privacy Policy:

Company (referred to as either “the Company”, “We”, “Us” or “Our”): Simplex Services, 12955 Biscayne Blvd #200-324, Miami, Florida, 33181, United States.
Application: The software programs provided by the Company, including Simplex Car Mate, Simplex Stima, Simplex Diagnostics, Simplex AppLock, and Simplex Mail.
Personal Data: Any information that relates to an identified or identifiable individual.
Service: Refers to the Application.
You: The individual accessing or using the Service.

Collecting and Using Your Personal Data
Zero-Server-Storage Policy

Unlike traditional apps, Simplex Services does not collect, store, or transmit your Personal Data to our own servers. Our applications are designed to be “Local-First,” meaning your data (such as trip logs, vehicle info, or messages) stays on your device.

Types of Data Processed

1. Local Data: Information you input into the app (e.g., vehicle details in Simplex Car Mate or diagnostic results in Simplex Diagnostics) is stored only in the Application’s private database on your physical Device.
2. Location Data (Sensitive Information): Simplex Car Mate accesses and collects your location data to enable its core features. This data is processed locally and is never transmitted to our servers.

Trip Logging: We access your precise location (latitude and longitude) at the start and end of a driving session to create trip logs and calculate distances traveled.
Driving Detection (Background Access): The app collects location data in the background (even when the app is closed or not in use) to monitor speed and movement patterns. This allows the app to automatically detect when you are driving, enabling “Driving Mode” and auto-reply features without manual intervention.
Real-time Dashboard: We use location data to calculate and display your current speed on the dashboard while the app is active.

3. Physical Activity: The app accesses your device’s physical activity sensors (Activity Recognition) to detect vehicle movement, walking, or running. This is used in conjunction with location data to automatically start or stop “Driving Mode” based on your activity.
4. Usage Data: Usage Data may be processed locally or by the operating system (Android/iOS) to ensure app stability. This includes your Device’s IP address, browser type, and diagnostic data. We do not aggregate this data to identify you.

Retention and Deletion of Your Personal Data
Retention Period

On Our Servers: We retain zero (0) personal data on our servers.
On Your Device: Your data is retained on your Device for as long as the Application is installed or until you manually delete it.

How to Delete Your Data

Since we do not store your data on our servers, we cannot delete it for you. You have total control over your data through the following actions:

Uninstalling the App: Uninstalling the Application from your Device will permanently delete all locally stored data, databases, and settings.
Clearing App Data: On Android, you can go to Settings > Apps > [App Name] > Storage > Clear Data to wipe all information without uninstalling the app.
In-App Deletion: Use the “Delete” or “Reset” functions within the app menus to remove specific records.

Sharing Your Personal Information

Because we do not collect or store your data, we do not sell, trade, or share your personal information with third parties. Information is only shared in the following limited technical scenarios:

With Service Providers:

We may use third-party tools (like the Google Play Store for subscriptions) that handle your payment data directly. Simplex Services never sees your payment details.

Law Enforcement: We can only disclose data if it exists. Since we do not store user data on our servers, we generally have no user information to provide to authorities.

Security of Your Personal Data

The security of your Personal Data is important to us. Because your data is stored locally, its security depends on your Device’s security (e.g., your phone’s passcode or biometric lock). We recommend keeping your Device updated and using built-in security features.

Children’s Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone. If you are a parent and believe your child has provided us with data, please note that this data is likely stored only on the device the child used. You can remove it by uninstalling the app.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the “Last updated” date.
